How to apply for a Federal Consistency Certification

There are two ways to submit an application for Federal Consistency Certification
  1. Regulatory Request System (RSS) – This form of filing only applies to projects or activities that require a permit from the U.S. Army Corps of Engineers (USACE). The USACE, the Department of Environmental Resources (DNER) and the PRPB established an agreement by which the RSS System in the case of Puerto Rico is a joint filing system that applies to simultaneously request the following permits and endorsements:
  • USACE Federal Permits for projects and activities impacting U.S. waters
  • Federal Consistency Certification with the PRCZMP
  • Water Quality Certificate from the DNER 
  • Submerged Lands Use Consession from DNER

The RSS System is accessed through the USACE portal at the following address: https://rrs.usace.army.mil/rss

    2. JP-833 form:

   a. This form is used to file the following types of projects:

  • Projects that require permits from federal agencies other than the U.S. Army Corps of Engineers (USACE). For example, the NPDES (National Pollutant Discharge Elimination System) discharge permits issued by the EPA
  • Applications for federal assistance (federal funds) to finance projects and activities that impact the waterfront.
  • Federal projects and activities as defined in subpart C of 15 CFR Part 930.

    b. Download the JP-833 form:

    c. Fill and sign the form and prepare the documents to be included as attachments.

    d. The form and required attachments (Descriptive memory, copy of endorsements, site plans and other required information) must be submitted in PDF format trough the following e-mail address: comentariosjp@jp.pr.gov
